T-2191-04: Affidavit of Tom Jackson
Court File No. T-2191-04
Federal Court - Trial Division
Between:
Arthur Mainil (Plaintiff)
-and-
The Canadian Wheat Board and Meyers Norris Penny (Defendants)
Affidavit
I, Tom Jackson, 2004 District 4 CWB Candidate, in the town of Killam, AB,
make oath and say that:
- I am a 2004 District 4 CWB Candidate, and as
such have personal knowledge of the matters presented and included in
my file: 171204 the "Supplementary Written Representation of the
Proposed Intervener Tom Jackson".
- I have not seen any of the Defendants
materials.
- I have received the Plaintiff's materials.
- I request the Honourable Court enter into
evidence Exhibit "C", "D", "E",
"F" and Exhibit "G" to this my Affidavit.
- I submit these Exhibits as evidence that the
Canadian Wheat Board, and Meyers Norris Penny, required producers to
swear false Statutory Declarations in order to receive Election
Ballots they were entitled to without swearing these Statutory
Declarations in the first place.
- Point 3 of the Exhibits "E",
"F" and "G" (the Statutory Declarations) require
the producer not to have a 2004-2005 permit book, while clearly Point
2 has the producer's permit book number included in the Statutory
Declaration. Were these producers tricked into disqualifying
themselves from the 2004 Election process? Will we ever know the
answer to this question?
- I request this evidence be submitted to
intervene in support of the application by Arthur Mainil for an
injunction against The Canadian Wheat Board and the election
coordinator and in support of his application that the election
process be repeated.
Sworn before me at Killam, in the Province of
Alberta this 17th day of December 2004.
(Signed by Michael E. Borth, a Notary Public in and for the Province of
Alberta)
(Signed by Tom Jackson)
